Important note: This template is drafted for YachtApp based on the current product functionality and European contract, consumer, platform-safety, and SaaS expectations. Replace all bracketed placeholders, confirm your company, governing law, consumer withdrawal model, payment setup, tax handling, and marketplace/platform status, and have qualified counsel approve the final text before publication.
1. About YachtApp
YachtApp is a digital vessel operations platform for private boat owners, captains, crew, clubs, charter teams, fleet operators, and ambassadors. The service may include boat records, maintenance logs, reminders, checklists, inventory, document storage, cruise planning, route planning, onboard people lists, CrewFinder profiles and opportunities, subscriptions, billing tools, contact forms, notifications, AI-assisted route or editorial features, and an ambassador portal.
These Terms form a legal agreement between you and:
[Legal company name]
[Registered address]
[Company registration/VAT number, if applicable]
Email: [support@yachtapp.net]
2. Acceptance
By creating an account, accepting an invitation, subscribing, publishing a CrewFinder profile or listing, joining the ambassador portal, or using YachtApp, you agree to these Terms and the Privacy Policy. If you use YachtApp for an organisation, vessel owner, club, or business, you confirm that you have authority to bind that entity and manage its data.
3. Eligibility and account security
You must be at least 16 years old, or the minimum age required in your country to use online services and enter these Terms. You must provide accurate information, keep your credentials secure, and notify us promptly of unauthorised access. You are responsible for activity under your account unless caused by our breach of these Terms.
4. Account roles and administration
YachtApp supports multi-user accounts, invitations, roles, permissions, and account context switching. Account owners and administrators are responsible for inviting appropriate users, assigning permissions, reviewing access, removing users who no longer need access, and ensuring that vessel, crew, passenger, and operational data is entered lawfully.
5. Subscriptions, plans, and billing
Some features are free and others require a paid subscription. Plans may set limits for boats, accounts, CrewFinder usage, storage, routes, or other features. Prices, currencies, billing periods, included features, trials, discounts, and promo codes are shown at checkout or in the admin/subscription area. Payments are processed by our payment provider, currently Stripe where enabled. You authorise us and our payment provider to charge applicable fees, taxes, and recurring subscription amounts until cancellation.
6. Renewal and cancellation
Paid subscriptions renew automatically unless cancelled before the renewal date. You may cancel using the available account or billing controls, or by contacting support if self-service cancellation is unavailable. Cancellation normally takes effect at the end of the current paid period unless mandatory law requires otherwise. We may change plan features or prices with reasonable notice where required by law.
7. Consumer withdrawal rights
If you are an EU or UK consumer, you may have a statutory right to withdraw from a distance contract within 14 days. Where you request immediate access to digital services during the withdrawal period, you acknowledge that your right to withdraw may be lost or reduced once performance starts, to the extent permitted by applicable law. We will provide any legally required cancellation instructions and model withdrawal information during checkout or onboarding.
8. Acceptable use
You must not misuse YachtApp. In particular, you must not upload unlawful, harmful, misleading, infringing, discriminatory, harassing, sexually exploitative, malware-bearing, or privacy-invasive content; access another account without permission; scrape, reverse engineer, overload, or disrupt the service; bypass subscription limits or security controls; use YachtApp for spam or deceptive referral activity; or enter personal data about others without a lawful basis.
9. Vessel operations and safety disclaimer
YachtApp helps organise information, but it is not a substitute for seamanship, professional maintenance, certified inspections, official navigation tools, charts, weather services, emergency equipment, maritime authorities, or legal compliance. Route planning, live location, AI analysis, reminders, checklists, maintenance suggestions, and exports may be incomplete, delayed, or inaccurate. You are solely responsible for vessel safety, navigation decisions, crew/passenger welfare, compliance with maritime laws, and verifying all information before relying on it.
10. User content and documents
You retain ownership of content you upload or create in YachtApp. You grant us a worldwide, non-exclusive licence to host, copy, process, transmit, display, and adapt that content as necessary to provide, secure, support, and improve the service. You confirm that you have the rights and permissions needed for all content you provide, including vessel documents, crew or passenger details, photos, logos, social links, and public CrewFinder content.
11. Public and shared features
Some features allow data to be shared with account members, invited users, CrewFinder participants, ambassadors, or the public. Review visibility settings carefully before publishing or inviting others. We may remove, restrict, or moderate content or accounts that appear to breach these Terms, legal obligations, safety expectations, or platform integrity requirements.
12. CrewFinder terms
CrewFinder helps owners, skippers, and crew connect for sailing, racing, delivery, day-sail, maintenance-help, or related opportunities. YachtApp does not employ crew, verify every user, guarantee credentials, provide maritime staffing advice, or ensure that an opportunity is safe, lawful, paid, insured, or suitable. Users must perform their own checks, agree terms directly where needed, comply with employment, volunteer, tax, immigration, safeguarding, insurance, and maritime rules, and use appropriate caution when meeting or sailing with others.
13. Ambassador portal and referrals
Ambassador features may allow approved users to access marketing resources, referral reporting, commission information, and campaign links. Ambassador participation is subject to approval and any separate ambassador agreement or commission plan. Ambassadors must make clear disclosures when they may receive compensation, must not make misleading claims, and must follow applicable advertising, consumer protection, and platform rules.
14. Third-party services
YachtApp may integrate with or depend on third-party services such as Firebase/Google Cloud, Stripe, SendGrid or email providers, map and geolocation services, AI providers, hosting providers, and app stores. Third-party services may have their own terms and privacy notices. We are not responsible for third-party services outside our control, but we will use reasonable care in selecting providers used to deliver YachtApp.
15. AI-assisted features
AI-assisted features are optional tools that generate suggestions or drafts based on available inputs. AI output may be inaccurate, outdated, incomplete, or unsuitable. You must independently verify output before use, especially for navigation, safety, compliance, maintenance, publication, or commercial decisions. Do not submit confidential, regulated, or sensitive personal data unless you are authorised and the submission is necessary.
16. Intellectual property
YachtApp, including software, design, trademarks, logos, documentation, workflows, and generated service structure, is owned by us or our licensors. Except for your user content and rights expressly granted by these Terms, no intellectual property rights are transferred to you. You may not copy, resell, sublicense, or create competing services from YachtApp except as permitted by mandatory law.
17. Service availability and changes
We aim to keep YachtApp available, secure, and useful, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, security work, provider issues, or force majeure events may affect availability. We may update, add, remove, suspend, or change features, provided that we respect mandatory consumer rights and any paid-plan commitments that apply.
18. Support
Support is provided through the channels we make available. We may prioritise security, billing, and paid-plan issues. We may access account information only as reasonably necessary to provide support, investigate problems, enforce these Terms, or comply with law.
19. Suspension and termination
We may suspend or terminate access if you materially breach these Terms, fail to pay fees, create security or legal risk, misuse CrewFinder or ambassador features, infringe rights, or where required by law. You may stop using YachtApp at any time and may request account deletion subject to legal retention, billing, audit, and backup requirements.
20. Data export and deletion
Where available, you may export certain records or documents from YachtApp. Before terminating an account or subscription, you should download data you need. Deletion requests are handled according to the Privacy Policy and applicable law. Backups and legally required records may remain for limited periods.
21. Warranties
To the maximum extent permitted by law, YachtApp is provided on an as-is and as-available basis. We do not warrant that the service will meet every operational, safety, legal, racing, charter, insurance, classification, or maintenance requirement. Nothing in these Terms limits statutory rights that cannot be excluded.
22. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, intentional misconduct, or any liability that cannot be excluded under applicable law. Subject to that, we are not liable for indirect or consequential losses, loss of profit, loss of revenue, loss of goodwill, loss of data where you failed to keep appropriate backups, vessel downtime, missed voyages, racing results, charter losses, or decisions made using incomplete or inaccurate operational information. Our aggregate liability for claims relating to YachtApp is limited to the fees you paid for the service in the 12 months before the event giving rise to the claim, unless mandatory law requires a higher amount.
23. Indemnity for business users
If you use YachtApp for a business, organisation, vessel operation, club, charter activity, or ambassador campaign, you agree to indemnify us against losses arising from your unlawful content, breach of these Terms, misuse of the service, breach of third-party rights, or failure to comply with laws applicable to your vessel, crew, passengers, promotions, or operations.
24. Changes to these Terms
We may update these Terms from time to time. We will notify users of material changes by email, in-app notice, or another reasonable method. If a change materially disadvantages you and mandatory law gives you a right to reject it, you may cancel before the change takes effect. Continued use after the effective date means you accept the updated Terms.
25. Governing law and disputes
These Terms are governed by the laws of [insert EU/EEA member state or other chosen jurisdiction], without prejudice to mandatory consumer protections in your country of residence. The courts of [insert venue] will have jurisdiction, unless mandatory consumer law allows you to bring claims in your local courts. EU consumers may also have access to national consumer bodies or other mandatory dispute-resolution channels.
